General terms of sale
These general conditions of sale apply to sales contracts concluded between:
- on the one hand, the company Verrerie d'Art de Kaysersberg, a limited liability company registered with the RCS of Colmar under number 441 890 811 (hereinafter referred to as "the Company")
- and on the other hand, any natural or legal person wishing to make a purchase via the website www.verrerie-kaysersberg.fr (hereinafter referred to as "the Buyer").
1. Object
These general terms and conditions of sale are applicable to any purchase made through the merchant site www.verrerie-kaysersberg.fr (hereinafter referred to as "the Site"), whether the Buyer is a professional or a consumer.
The acquisition of a good through this Site implies the unreserved acceptance by the Buyer of these general conditions of sale.
These general conditions of sale shall prevail over all other general or specific conditions, unless prior written agreement is given by the Company.
The Company reserves the right to modify its general conditions of sale and prices at any time. In this case, the applicable conditions and prices will be those in force on the date of the Buyer's order (see article 4 below).
2. Products for sale
The Company offers for sale all models of articles appearing in the "Online shop" section of the Site..
Each model of item offered for sale is accompanied by a descriptive photo, a characteristic sheet and the sale price including all taxes (TTC) of said model.
The Company makes its best efforts to ensure that the photographic representation of the item model is as faithful as possible to the item offered for sale. However, due to the uniqueness of each of the items produced by hand and by hand, each item of the same model (and therefore of the same name) presents variations in the nuances and arrangement of the added colors. Only the dominant color remains almost constant, which serves as a reference for the name of each item model.
3. Price, Shipping Costs and Packaging
The prices listed in the catalog are inclusive of all taxes (TTC) in euros for Metropolitan France and the European Union, taking into account the French VAT in effect on the day of the order. For deliveries outside the territory of Metropolitan France or the European Union, the provisions of the General Tax Code relating to VAT will apply.
The prices indicated do not include order processing and transport costs.
Order processing and transport costs are invoiced in addition according to the scale below or appearing in the "Delivery" section of the Site.

These order processing and shipping fees apply to Metropolitan France or any other country in the European Union. For any other destination, additional order processing and shipping fees may apply.
The products ordered are only shipped after the Company has received payment of the price and the corresponding order processing and transport costs (see article 4 below).
If the Buyer does not wish to make an online payment, he/she may nevertheless place an order by mail (to the postal address Verrerie d'Art de Kaysersberg, 30 rue du Général de Gaulle, 68240 Kaysersberg, France) or by email (to the email address ), mentioning all the data necessary for processing the order (name, delivery address, telephone number and exact name of the item ordered). Upon receipt of this written order (mail or email), the Company will inform the Buyer of the exact amount of the order, including order processing and shipping costs. Any written order (mail or email) is subject to advance payment by check and will only be shipped after the check has been cashed by the Company.
4. Orders
The Buyer, who wishes to purchase a product via the Site must click on the "Add to cart" button and then follow the steps described on the Site, namely:
- fill out the identification form on which he will indicate all the requested contact details or identify himself if his form has already been completed;
- reread the summary of his order and ensure that all the items selected by the "Add to cart" button appear on the list, it being specified that at this stage of the order, the Buyer has the possibility of canceling all or part of his order;
- validate his order after checking the order form;
- make the payment online under the conditions provided on the Site. In this regard, the Buyer expressly declares that he is authorized to use the payment card to pay for his order.
The order confirmation entails unreserved acceptance of these general terms and conditions of sale, which the Buyer expressly acknowledges having read, the price and the costs of order processing and transport of the product thus purchased. The confirmation also constitutes a waiver by the Buyer to avail himself of his own conditions of purchase or other special conditions whatsoever, unless prior written agreement is given by the Company.
All data communicated by the Buyer and its recorded confirmation will constitute proof of the transaction. The order confirmation will constitute signature of the purchase contract.
The Company will confirm the recorded order to the Buyer by email and will indicate, for information purposes, the delivery time as announced by La Poste (see article 6 below), it being specified that the maximum delivery time is thirty (30) days from the final order.
In the event of temporary unavailability of an ordered product whose artisanal and manual manufacturing time would result in exceeding the maximum delivery time of thirty (30) days referred to above, the Company will inform the Buyer by email, indicating the expected date of availability. The Buyer will then have the option of either (i) accepting delivery of a product of equivalent quality and price or (ii) being reimbursed for the price of the product ordered within thirty (30) days of their order (see article 5 below).
The Company reserves the right to refuse any new order from a Buyer with whom the Company is in dispute in relation to any previous purchase and in particular in the event of a payment incident.
5. Right and period of Withdrawal
In accordance with Article L121-20 of the Consumer Code, the Buyer has a withdrawal period of fourteen (14) days from the delivery of his order to return the product without justification, for exchange or refund without penalty.
The costs incurred for the return of the product remain the responsibility of the Buyer.
To benefit from the right of withdrawal, the returned product must comply with the conditions set out in Article 8 "Return of Product" below.
Finally, it is specified that products manufactured according to the Buyer's specifications or personalized at the Buyer's request are excluded from the right of withdrawal.
6. Delivery
Delivery is made to the address indicated on the order form.
Packages are generally shipped within 8 days of receipt of your payment.
Each delivery is made by La Poste by registered mail with delivery against signature. The standard delivery method is Colissimo 48 h.
Delivery times are given for information purposes only; if they exceed thirty (30) days from the order, the sales contract may be terminated by the Buyer and the Buyer reimbursed.
7. Guarantee
In the event of non-conformity of the product sold to its order as confirmed by the Buyer or of a defect in the product sold, the Buyer may return it to the Company, which will take it back and exchange it or refund it, at the Buyer's choice.
All claims, requests for exchange or requests for refund under this warranty must be made within a maximum of thirty (30) days from the delivery of the product in question.
By "non-conformity" are meant the following cases:
- the item received by the Buyer is different from that appearing on the order form, by the model or the color,
- the item received by the Buyer has a manufacturing defect making it unfit to fulfill its function under the expected conditions of use and aesthetics, such as twisted vase foot, chipped edge, glass split...
For the cases of non-conformity defined above, and for these cases only, the Company will bear the costs of returning the non-compliant product. This support will be carried out by crediting a bank card for payments made by card, or by issuing a credit note for payments made by check.
The amount of the refund or credit note will be established according to the company's price list, in the attached appendix.
If the costs incurred by the Buyer for the return of the item exceed the costs established according to the Company's scale, the difference will not be credited, or will not be the subject of a credit note.
Complaints and requests for exchange or refund must be sent, accompanied by the non-compliant item, under the conditions stipulated in article 8 "Return of Product" below. Failing this, the warranty will not apply.
In the event of a refund request accepted under the above conditions, the Company will proceed with the refund within thirty (30) days following the Buyer's refund request.
8. Return of Product
Any request for return, exchange or refund by the Buyer in application of both Article 5 "Right and period of Withdrawal" and Article 7 "Guarantee" must meet the following conditions.
Prior to returning any product, the Buyer will send the Company by email (to the email address ) a request explaining the subject and reason for his request as well as the date of his initial order. The Company will provide the Buyer with a return number to attach to the returned product.

The product must be returned properly protected in its original packaging so as not to be damaged during return transport, which is particularly important for glass objects.
The product must be accompanied by the return number provided by the Company, as well as a copy of the original invoice.
9. Protection of personal data
The information collected is subject to computer processing intended for the management by the Company of its customer file. Personal data transmitted as part of any purchase on the Site will be kept for the exclusive use of the Company.
Verrerie d'Art de Kaysersberg undertakes in principle not to transmit any of this personal data to any third party whatsoever.
In accordance with the "Information Technology and Freedoms" law of January 6, 1978, amended in 2004, the Buyer has a right to access and rectify information concerning him, which he can exercise by writing to:

10. Applicable Law and Competent Courts
These general terms and conditions of online sale are subject to French law, regardless of the place of delivery of the products purchased.
In the event of a dispute, the courts of Colmar will have exclusive jurisdiction, regardless of the place of delivery of the products purchased.
